冒充记者敲诈勒索 三人获刑并处罚金

margin-bottom: 1em; padding: 0px; list-style: none; color: rgb(36, 36, 36); font-family: 宋体; text-align: justify; white-space: normal; background-color: rgb(255, 255, 255); line-height: 2em;"><span style="font-family: arial, helvetica, sans-serif;"> 2021年1月份以来，一男子王某打着“记者”的旗号实施敲诈勒索，10个月内向某乡镇政府、企业、学校、医院等敲诈勒索16次，勒索钱财38100元。王某通过市长留言板或其他网站、媒体发布的信息，找出一些能够引起舆论关注的内容，然后到实地查看、拍摄照片，再根据政府主管部门公布的负责人联系电话，假冒媒体记者以曝光或者举报给上级部门相威胁，迫使相关单位或个人支付封口费、油费等费用。</span></p><p style="margin-top: 0px; margin-bottom: 1em; padding: 0px; list-style: none; color: rgb(36, 36, 36); font-family: 宋体; text-align: justify; white-space: normal; background-color: rgb(255, 255, 255); line-height: 2em;"><span style="font-family: arial, helvetica, sans-serif;"> 王某多次实施犯罪后，担心使用本人微信收款不安全，找到其朋友刘某索要微信收款码，允诺给予刘某好处。刘某又找到李某，说需要暂时借用收款码，会给好处费，李某便把妻子的微信收款码提供给刘某，刘某将李某妻子的微信收款码交给王某使用。后李某发现进账的钱均备注“记者费”，询问时刘某承诺给其加钱，李某便不再询问。</span></p><p style="margin-top: 0px; margin-bottom: 1em; padding: 0px; list-style: none; color: rgb(36, 36, 36); font-family: 宋体; text-align: justify; white-space: normal; background-color: rgb(255, 255, 255); line-height: 2em;"><span style="font-family: arial, helvetica, sans-serif;"> 后因敲诈数额越来越大，王某担心自己的罪行太重，主动投案自首。唐河县人民法院经审理认为，被告人王某多次敲诈勒索他人财物，虽每次犯罪数额较少，但次数多，社会危害较大，其行为已构成敲诈勒索罪。鉴于被告人王某能主动投案，如实供述罪行，且已退赔各被害人遭受的全部经济损失，取得了所有被害人的谅解，可对其从轻处罚。被告人刘某、李某在王某敲诈勒索时起提供收款码及收款辅助作用，系从犯，且到案后能如实供认自己的罪行，应当从轻或减轻处罚。遂依法作出上述判决。</span></p><p style="margin-top: 0px;
